Privacy Policy

This Privacy Policy (“Policy”) explains what personal data is collected or processed when you use the website warehousegamification.com (“Website”), why, on what legal basis, who receives it, how long it is kept, and what rights you have. It is consistent with and complements the Privacy Policy of www.motivacraft.com, which also covers the Motivacraft application.

1. Who we are

The Website is operated by Motivacraft Inc., 3 Germay Dr, Unit 4 #1129, Wilmington, Delaware, USA (“Motivacraft”, “we”). For the personal data collected through the Website, Motivacraft Inc. is the data controller. For anything about your personal data you can write to hello@motivacraft.com.

2. What personal data we collect

You can visit the Website without telling us who you are. Personal data is collected in these cases:

  • Contact form: your full name, your e-mail address, your company name, the subject and your message. The form sends them to us by e-mail; they are not stored on the Website.
  • Technical data: when you open a page, your browser sends your IP address, the type of your browser and device, the page you ask for and the time. Our hosting provider Cloudflare processes this data to deliver the Website and to protect it and its form against misuse (Cloudflare Turnstile checks that the form is sent by a person). If a script fails in your browser, a short technical report (the error, the page’s address and the type of browser) is written to our server log so that we can fix it; it holds no name and no contact details.
  • Statistics and marketing: depending on your choice in the cookie notice, Google Analytics records how the Website is used (such as the pages visited, the kind of device and the approximate location), and Google’s advertising services measure our campaigns.
  • Videos: the product video is hosted on Vimeo. It is loaded only when you open it, with Vimeo’s “do not track” setting; Vimeo then receives your IP address and processes it under its own policy.

We only collect information necessary to answer your requests and for legitimate business purposes. We do not sell, rent or market your personal data.

3. Why we use your data and on what legal basis

  • To answer your message and to prepare an offer or a meeting (contact form): steps taken at your request before entering into a contract, and our legitimate interest in answering those who write to us.
  • To deliver the Website, keep it secure and fix errors (technical data): our legitimate interest in running a working and secure website.
  • Statistics and marketing tools: your consent, given in the cookie notice, wherever the law requires it. You can change your choice at any time.
  • To keep the records the law requires and to establish, exercise or defend legal claims: our legal obligations and legitimate interests.

These grounds correspond to Article 6(1)(a), (b), (c) and (f) of the European Union’s General Data Protection Regulation (“GDPR”) and to Article 5 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”). Your personal data is collected by automated means, through the form, cookies and similar technologies described in this Policy.

4. Who receives your data

We use the following service providers, which process personal data on our behalf or as part of their own service:

  • Cloudflare: hosting and delivery of the Website, security and the protection of the form (Turnstile),
  • Resend: delivery of the contact form’s e-mail to us,
  • Google: Google Analytics and the measurement of advertising,
  • Vimeo: the product video, when you open it.

We may also disclose personal data to the competent authorities when the law requires it, or to protect our rights, our users or others.

5. International data transfers

Motivacraft Inc. is established in the United States of America, and the service providers named above are based in the United States or work worldwide. Personal data collected through the Website is therefore processed in the United States and in the other countries where these providers have their servers, outside the Republic of Türkiye and the European Union. For personal data from the European Economic Area, the United Kingdom and Switzerland, we rely on the safeguards these providers offer for such transfers, such as the European Commission’s standard contractual clauses or the EU–U.S. Data Privacy Framework.

6. How long we keep your data

Messages sent with the contact form are kept in our mailbox for as long as we need them to deal with your request and with the business relationship that may follow. Technical logs are kept by our hosting provider for a limited time. The periods of the statistics and marketing cookies are given in our Cookie Policy. At the end of these periods your personal data is deleted or anonymized.

7. Protection of your data

We take technical and organizational measures to protect your personal data against unauthorized access, loss or misuse: the Website is served only over encrypted connections (HTTPS), the form is protected against automated misuse, and only a limited number of people can read the messages it sends.

8. Artificial intelligence

The Website has no chatbot or other AI feature. Your form messages and your use of the Website are not sent to any AI service by the Website. We do not use the information you send us with the contact form to train artificial intelligence models.

9. Your rights

Depending on the law that applies to you, you have the following rights.

Under Article 11 of the KVKK, you have the right to:

  • learn whether your personal data is processed,
  • request information about it if it has been processed,
  • learn the purpose of the processing and whether the data is used in line with that purpose,
  • know the third parties, in Türkiye or abroad, to whom your personal data is transferred,
  • request the correction of personal data that is incomplete or inaccurate,
  • request the erasure or destruction of your personal data under the conditions of Article 7 of the KVKK,
  • request that the third parties to whom your personal data was transferred are told of such a correction, erasure or destruction,
  • object to a result to your disadvantage that arises from the analysis of your data by automated systems alone,
  • claim compensation for damage you suffer because your personal data was processed unlawfully.

Under the GDPR (if you are in the European Economic Area, the United Kingdom or Switzerland), you have the right to access your data, to have it corrected or erased, to have its processing restricted, to object to its processing, to data portability, to withdraw your consent at any time, and to lodge a complaint with the data protection authority of your country.

To use these rights, write to hello@motivacraft.com or to our postal address above. We answer within the time the law sets: within thirty days at the latest under the KVKK, within one month under the GDPR. We may ask you for information that confirms your identity. If you are in Türkiye and our answer does not satisfy you, you can complain to the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu).

10. Cookies

The Website uses cookies and similar technologies as described in our Cookie Policy. On your first visit a notice asks for your choice, and the “Cookie settings” link at the bottom of every page lets you change it at any time. In the European Union and the European Economic Area, the United Kingdom, Switzerland and Türkiye, statistics and marketing tools are not used until you allow them.

11. Communication permission

By using the Website and providing your contact details, you consent to receiving electronic communications from us regarding services, updates, and promotions. You can withdraw your consent at any time by following the opt-out instructions in our communications or by writing to us.

12. Changes to this Policy

We may change this Policy over time. Changes will be posted on this page with the date of the update. Please review this Policy periodically to stay informed about how we protect your information.
